Workers’ Comp Claims Against Amazon & FedEx

Both Amazon and FedEx have centralized operations in Maryland. Massive warehouses, unfortunately, often correlate to injured workers. The Maryland Workers’ Compensation Act gives an injured worker and their dependents a no-fault method of recourse against their employer for compensation due to accidental injuries arising out of and in the course of employment.

Nonetheless, while this is a no-fault method, FedEx claims are typically contested due to causation. For a workers’ compensation claim to be compensable, it must have arisen and occurred within the scope of employment. It can be difficult to pinpoint the origin of repetitive stress injuries suffered by FedEx workers because they complete the same actions, day after day. This makes it easier for the insurance company to blame the worker’s injury on old age, degenerative changes, arthritis, etc. for the issue.

When this happens, our attorneys know what to do. We can send our client to our IME doctors to causally relate the injury to a work injury and battle it out before the Workers’ Compensation Committee. Typically, these cases can be settled before additional litigation because we can often successfully advocate on behalf of our client and convince the defense that they cannot deny a claim on this basis.
