Obtaining Compensation for Your Injuries
People suffer injuries in accidents on a daily basis in Prince George’s County. Very often, these accidents are the result of another person’s negligence. Because these accidents were caused by other people’s negligence, the victims of these accidents may be entitled to compensation for their injuries.

Do not allow yourself to be left at the mercy of an insurance company. Our attorneys can work with you to build a successful case.

Elements of a Personal Injury Claim
The legal elements of a personal injury claim are duty, breach, causation, and damages. A victim has a prima facia personal injury case when another person’s negligence caused them to suffer an injury.
For example, all automobile drivers owe each other a duty of care. When an automobile driver performs an act of negligence, such as failing to stop for a stop sign, the failure to stop at the stop sign is a breach of their duty. If another person suffered an injury as a result of the driver’s failure to stop, a victim has the necessary evidence to fulfill the causation and damages elements of a personal injury claim.
To win a personal case, a personal injury must prove all the elements of their claim by a preponderance of the evidence, i.e., 51%.
Workers’ Compensation Claims
Individuals that suffered injuries at work may be entitled to make a workers’ compensation claim. To have a viable workers’ compensation claim, a victim must have suffered an accidental injury while in the scope of their employment. Workers’ compensation is a form of “no-fault” insurance, which means that a victim has a compensable claim if their own negligence or another person’s negligence caused their injury.
Because of the extensive benefits available in a workers’ compensation claim, insurance companies fiercely defend these claims. The benefits available through workers’ compensation insurance are extensive and varied.
Injuries & Compensation in a Personal Injury Claim
Victims of accidents often suffer bodily injuries. These injuries usually require a victim to receive medical treatment and rehabilitative care such as physical therapy. Medical treatment and physical therapy are not free, nor are they cheap. Very often, personal injury victims are financially crippled as a result of medical bills.
Fortunately, Maryland Law allows permits a personal injury victim to seek compensation. Specifically, personal injury victims can recover economic damages such as the cost of their medical treatment and non-economic damages such as the pain and suffering they endured as a result of their injuries.
Denials & Defenses
Maryland law allows a civil defendant to raise several defenses to a personal injury claim. The standard defenses are contributory negligence and assumption of risk. Both defenses prevent a victim from recovering anything if successful.
To successfully raise contributory negligence, a civil defendant must prove that a personal injury victim engaged in a negligent act that contributed to their injury. To successfully raise assumption of risk, a civil defendant must prove that a personal injury knew of a risk, appreciated it, and despite knowing a potential undertook a risky action. Insurance companies frequently use these defenses to deny valid personal injury claims.
