What is a Personal Injury Claim?
In essence, a personal injury claim is a civil action that permits a person to seek recompense for damages they sustained due to another party’s negligent or wrongful actions. There are four primary legal elements of a personal injury claim.
Those elements are:
- Duty
- Breach
- Causation
- Damages
The final aspect of personal injury litigation is the applicable defenses. These are the arguments the opposing side will make to eliminate/reduce your compensation. For example, the opposing insurance company may argue that the victim was contributorily negligent or assumed the risk of their injuries.
Under the affirmative defense of contributory negligence, a victim is entirely precluded from recovering if the other side proves that the victim’s negligence contributed to the accident. With respect to “assumption of the risk,” if the opposing party provides evidence that the victim was aware of the potential risk of harm, understood or appreciated that risk, and nonetheless voluntarily undertook the action, the victim is precluded from recovering.
If the defense is successful in arguing the plaintiff’s negligence contributed to her injuries, then the plaintiff is wholly barred from recovering. A knowledgeable personal injury attorney will evaluate the circumstances of your case with you and help defend you against claims of contributory negligence or assumption of the risk.
Workers’ Compensation
Our experienced litigation team also handles countless workers’ compensation cases. These cases involve a victim who suffered an injury while at work. Workers’ compensation permits injured workers to file without having to sue their employer. However, to have a compensable workers’ compensation case, the victim’s injury must have been accidental and “arisen out of and occurred within the scope of employment.”
These requirements and experienced defense counsel used by most insurance companies may result in a workers’ compensation claim being denied. This is why you should get the experience and knowledge of the attorneys at Portner & Shure, P.A. We are seasoned professionals and advocate on behalf of our clients for the compensation they are owed.
Injuries & Damages
Accident victims sustain a wide variety of injuries. Many of these injuries require emergency medical treatment. Further, for a victim to make a full recovery, they oftentimes need ongoing medical treatment like physical therapy, orthopedic care, or occupational therapy. Accident victims consistently find themselves unable to return to work due to their injuries.
The innocent victims of car accidents, and those injured on the job, are entitled to recover both economic and non-economic damages. Economic damages encompass things like medical bills, lost wages, and future lost wages/salary. Noneconomic damages intend to compensate the victim for the pain and suffering they endured as a result of this accident.
An experienced attorney will work with you to understand the circumstances of your accident, and how it impacts your daily life. We will advocate on your behalf, and fight for the compensation you are rightfully owed.
